Judge
Yohn rejects deposition of Arnold Beverly,
citing the Effective Death Penalty Act
In
a ruling dated July 19, Judge William H. Yohn adopted the position
of the state's attorney in rejecting Mumia's request to depose
Arnold Beverly. Beverly had summitted a sworn statement that he,
not Mumia, was the killer of Officer Daniel Faulkner.
Judge
Yohn's ruling is a textbook example of how the Effective Death
Penalty Act of 1996 to set up to block all avenues of appeal by
the wrongfully convicted. Further, Judge Yohn goes out of his
way to instruct the Pennsylvania state courts that they should
likewise reject consideration of the Beverly affidavit
